1. App Owner

The mobile application "Cookit" (hereinafter, the "App") is developed and managed by:

The Owner acts as an individual within the scope of a personal project.

2. Scope and Acceptance

2.1. These Terms and Conditions (hereinafter, "Terms") govern the use of the "Cookit" App by its users.

2.2. By installing, accessing or using the App, the user fully accepts these Terms. If you do not wish to accept them, you must not use the App.

2.3. The App is intended primarily for private consumers (personal and non-professional use).

2.4. The App may be used by minors only with the consent and under the supervision of parents or legal guardians, who remain responsible for the minor's use.

3. App Description and Key Features

3.1. "Cookit" is an App dedicated to culinary recipe management, which allows users to:

  • create, edit and organise personal recipes;
  • manage ingredients and information associated with recipes;
  • share recipes with other App users ("shared recipes" feature);
  • manage friendships and friend requests between users;
  • upload and view recipe photos and profile pictures;
  • receive push notifications (e.g. for friend requests or shared recipes).

3.2. Some features may be subject to technical or quantitative limits (e.g. maximum number of friends, maximum number of shareable recipes), which may change over time.

3.3. The App offers additional features or paid services (the "PRO" plan or similar). The specific conditions of such services will be shown within the App prior to purchase.

4. Registration, Account and Authentication

4.1. To use the App's core features, users must authenticate via an external identity provider, which manages the login process and credentials.

The user is responsible for:

  • keeping their credentials with the identity provider confidential;
  • verifying the accuracy of their account data (name, email, etc.);
  • not allowing others to use their account without authorisation.

4.3. The Owner is not responsible for any unauthorised access resulting from the user's poor management of credentials.

4.4. The user warrants that the data provided is truthful, up to date and complete to the extent necessary for the proper functioning of the App.

5. User-Generated Content (Recipes and Photos)

5.1. The App allows users to insert and manage user-generated content, including:

  • recipe texts, ingredients, descriptions;
  • recipe photographs;
  • user profile picture (avatar).

5.2. The user retains ownership of the rights to the content they upload, to the extent permitted by applicable law.

5.3. By uploading content to the App, the user grants the Owner a non-exclusive, royalty-free, revocable, worldwide licence to use such content solely for the purpose of:

  • enabling the operation of the App;
  • storing and displaying recipes and photos to the user and to users with whom they are shared;
  • performing backups, technical logs and operations strictly connected to the service.

5.4. The user is solely responsible for the content they upload or share and warrants that such content:

  • does not infringe third-party rights (e.g. copyright, trademarks, image rights);
  • does not contain defamatory, discriminatory, obscene, violent, pornographic or unlawful material;
  • does not depict individuals or minors in a manner that violates their dignity, privacy or image rights.

5.5. It is expressly prohibited to upload, share or store via the App:

  • images or texts that incite hatred, violence or discrimination;
  • pornographic or sexually explicit content;
  • content depicting minors in an inappropriate or harmful manner.

5.6. The Owner reserves the right (but not the obligation) to remove or hide content that it reasonably considers to be in violation of these Terms or applicable law.

6. Acceptable Use and Prohibited Conduct

6.1. The user agrees to use the App in accordance with:

  • applicable law;
  • these Terms;
  • common sense and good faith.

6.2. The following are prohibited, by way of example:

  • using the App for unlawful or fraudulent purposes;
  • attempting to gain unauthorised access to systems, databases or other users' accounts;
  • circumventing or compromising security measures or technical restrictions;
  • reverse engineering, decompiling or modifying the App, except as permitted by mandatory applicable law;
  • using scripts or automated tools that may compromise the operation or stability of the service.

6.3. In the event of serious or repeated violations, the Owner may:

  • restrict access to certain features;
  • suspend or block the user's account;
  • take such legal action as it deems appropriate.

7. Free Features and Paid Services (PRO Plan)

7.1. The App offers a range of free features.

7.2. Additional paid features are also available (the PRO plan), which may include, by way of example:

  • expanded usage limits (e.g. number of shareable recipes or friends);
  • advanced recipe management features;
  • other improvements or extra services.

7.3. Pricing, payment methods and any applicable withdrawal rights are clearly set out within the App at the time of purchase of the PRO plan.

7.4. Unless otherwise indicated, payments are processed through the payment systems made available by the platform (e.g. Google Play Store), which also apply their own terms and conditions.

8. Push Notifications

8.1. The App uses push notifications to inform the user, for example, about:

  • received friend requests;
  • acceptance of sent friend requests;
  • recipes shared by other users;
  • any other communications related to the operation of the service.

8.2. The user may enable or disable certain notification categories via the App's settings and/or the device's operating system settings.

8.3. Disabling push notifications may prevent timely receipt of certain information; the user assumes responsibility for this choice.

9. Data, Ingredients and Open Food Facts

9.1. Some information on ingredients or products may come from external databases such as Open Food Facts.

9.2. The App may contain data from Open Food Facts, subject to the following licences:

9.3. Data relating to ingredients, nutritional values, allergens, etc. may be incomplete or out of date. Users are required to:

  • always verify information on the labels of actual products;
  • take into account any allergies, intolerances or personal dietary requirements.

9.4. The Owner does not guarantee the accuracy, completeness or currency of such data and accepts no liability for any consequences arising from improper use of the information (e.g. in cases of unacknowledged allergies or intolerances).

10. Security and Service Availability

10.1. The Owner undertakes, to the best of its ability, to keep the App operational and secure. However, it cannot guarantee:

  • the absence of interruptions, malfunctions or errors;
  • full compatibility with every device and operating system version;
  • continuous availability of the service over time.

10.2. The Owner may temporarily suspend the App (e.g. for maintenance, updates or technical issues) or permanently discontinue it, without incurring liability towards the user, subject to any refund of paid services as provided by applicable law and specific purchase terms.

11. Liability

11.1. The user uses the App at their own sole risk.

11.2. To the maximum extent permitted by law, the Owner is not liable for:

  • direct or indirect damages, data loss, loss of profit or other financial losses arising from the use of, or inability to use, the App;
  • any decisions made by the user based on recipes, suggestions or data displayed in the App (e.g. dietary choices, diets, changes to medical treatments);
  • unlawful conduct or violations committed by users through the App.

11.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law.

12. Privacy and Personal Data

12.1. The processing of users' personal data (e.g. profile data, settings, preferences, notification tokens) is governed by a separate Privacy Policy, available within the App.

12.2. Users are encouraged to read the Privacy Policy carefully to understand how personal data is collected, used and protected.

13. Intellectual Property

13.1. The App, its code, design, logo and other graphic elements (excluding user-generated content and data from third parties such as Open Food Facts) are the property of the Owner or licensed to the Owner.

13.2. It is prohibited to copy, distribute, modify or reuse any part of the App beyond what is permitted by its normal use, except as otherwise provided by mandatory law.

14. Changes to These Terms

14.1. The Owner may amend these Terms at any time, for example to:

  • comply with regulatory changes;
  • introduce new features;
  • improve the clarity or security of the service.

14.2. Changes will be made available through an App update or the publication of an updated version of the Terms.

14.3. Continued use of the App after the publication of updated Terms implies acceptance of the changes.

15. Applicable Law

15.1. These Terms are governed by Italian law, without prejudice to any mandatory rights that may be afforded to the user as a consumer under the law of their country of residence.
